GENERAL TERMS AND CONDITIONS CONTENTS & ARTICLES.

ARTICLE 1- IDENTIFICATION FOR TRAVEL.

It is the responsibility of the passenger to ensure that they have the correct documentation for travel. Prior to travel, you must present all exit, entry, health and other documents required by law, regulation, order, demand or other requirement of the countries concerned, and permit us to take and retain copies thereof. We reserve the right to refuse carriage if you have not complied with these requirements, or your travel documents do not appear to be in order.

1.1 International & Domestic flights to, from and within the U.K.
Passengers must present valid photo-ID at check-in for international flights and Domestic flights within the UK.

The only accepted forms of photo ID for the UK are:
• Valid passport
• Valid driving licence with photo
• Valid national ID with photo
• International Student Card
• Bus Pass with photo
• Work ID with photo
• Northern Ireland Electoral Card. (With Photo.)
• NATO/ U.N. Military I.D

The IDs mentioned are for airline purposes only to verify the ID of the passenger against the name in the reservations system. However the passengers must ensure that they comply with all immigration requirements regarding passports/visas when travelling with us independently of the Aer Arann ID policy. Evidence of Passport/Visa may be required at check in.

1.2 Continental Europe
The only accepted forms of photo ID for Continental Europe are:

• Valid passport.
• Valid National ID with photo. (No other forms of photo-ID are acceptable)

Expired forms of Photo-ID will not be accepted.

Children under the age of 16 years (under 18 years if travelling from France) travelling with an adult who has a valid photo-ID do not need photo-ID.

Failure to present valid photo-ID matching the names on your reservation will result in you being refused check-in without refund.

Passengers, who are holding a reservation in their married name but are travelling on a passport in the ir maiden name, must also have their marriage certificate showing both names

A child between 12-16 years travelling alone with in Ireland or U.K. or between Ireland and the U.K. must produce a Form of Photo I.D.

A child between 12 -17 can travel out of France if they have a valid French Passport and has the equivalent of the Young Flyers Form of Indemnity completed by a parent/guardian for these passengers at each airport of departure. If the Child has only a National Identity Card, they will also need a certificate issued by the City Council with the name of the parents, with an official seal on the document, which will allow the child to travel on their own. The Young Flyers Form of Indemnity must be still completed by a parent/guardian for these passen gers at each airport of departure.

ARTICLE 2-BAGGAGE INFORMATION.

2.1 BAGGAGE POLICY.

Aer Arann requires that all checked baggage is clearly identifiable with your name and address and contact numbers or alternatively your flight confirmation number. Failure to comply with this requirement will result in a significant delay in the delivery of your baggage should your baggage be misplaced. A notice of baggage liability limitations can be found in the Air Carriers Liability Notice for passengers and their baggage . Passengers are advised to familiarise themselves with these conditions prior to travel on an Aer Arann flight. Certain items are not permitted for carriage in Checked or Unchecked Baggage. These are listed below under the details of ‘Dangerous Articles in Baggage’.

In addition to these conditions, Aer Arann also has the following policy with regard to baggage:
In the course of normal handling, your luggage may show signs of wear and tear. Aer Arann accepts no responsibility for the following and will only carry the following on a limited release basis :

• Minor cuts, scratches and dents
• Items that protrude from luggage such as wheels, luggage feet and handles
• Items of a fragile (musical and sporting equipment) or perishable nature
• Over packed bags
• Loss of external locks, zips, pull straps or security straps
• Manufacturer’s defects
• Baggage accepted after the check-in closure time.
• Baggage containing valuable items.
• Umbrellas.
• Child’s pushchair/buggy.

You must not include in Checked Baggage money, jewellery, medication, precious metals, keys, cameras, computers, personal electronic devices, negotiable papers, securities or other valuables, business documents, passports and other identification documents or samples.

Aer Arann is prepared to carry such items on a ‘Limited Release’ (i.e. entirely ‘at your own risk’ for loss, damage, or delay) basis. You will be required to sign acknowledgement of ‘Limited Release’ at the time of check-in. You may therefore wish to ensure that you have sui table private insurance cover for you journey.

2.2 BAGGAGE ALLOWANCE

Checked baggage allowance:
20kgs per passenger on all flights. The maximum total weight for any one piece of checked baggage is 32 kgs.

Infant Baggage weight Allowance - Nil
Stroller/ Buggy Allowance - 1 piece per infant booked

2.3 INFANT EQUIPMENT.

Infant Equipment including but not limited to prams, buggies, cots, and car seats are considered to be inherently unsuitable for carriage by air. It is possible to carry such items to the aircraft and such items will be loaded as checked baggage at that time. Aer Arann is prepared to carry such items on a ‘Limited Release’ (i.e. entirely ‘at your own risk’ for loss, damage, or delay) basis. You will be required to sign acknowledgement of ‘Limited Relea se’ at the time of check-in. You may therefore wish to ensure that you have suitable private insurance cover for you journey. Only 1 piece of infant equipment is permitted per infant booked.

2.4 CABIN BAGGAGE ALLOWANCE.

One piece of cabin baggage is permitted per passenger, which must not weigh more that 7 Kg and must be small enough to fit comfortably in the overhead bin or under the seat in front not exceeding 23cm x 28cm x 43cm (9x11x17ins). Passengers should carry all medication in their cabin baggage.

2.5 EXCESS BAGGAGE.

Excess baggage may be accepted if space is available, on payment of the appropriate excess baggage fees. EUR 3 per kilo / GBP 3 per kilo is payable for excess baggage on all Aer Arann flights.

2.6 CARRIAGE OF PETS:
Carriage of Pets is only permitted on Ireland domestic and UK flights to and from Ireland.

On Aer Arann flights the carriage of pets is permitted in the baggage hold of the aircraft only.
Pets must be contained in a crate, which is escape-proof, leak-proof and of sufficient size to allow the pet to stand up, turn around and lie down fully stretched.

The maximum dimensions permitted in an ATR42 and ATR72 aircraft are 21 ins. high X 22 ins. wide X 50 ins. long.

Domestic Dogs and cats must be at least 10 weeks old before Aer Arann will transport them. Aer Arann will accept no other pets or animals or birds for travel .

Rates: the pet and container need to be weighed separately. From any other baggage you may have and charged at a rate of €22/£15 per pet. You are liable for a fee of € 22/£ 15 per pet per sector/ flight.

Aer Arann will accept up to 2 pets for travel per flight. They must be in their individual containers.
Carriage of Pets is on a ‘ Space Available ’ basis only, a pet may be refused travel up to and including the scheduled departure time.
Guide dogs accompanying Passengers with disabilities will be carried free of charge in addition to the normal free baggage allowance , The airline must be advised in advance of travel.
Where carriage is not subject to the liability rules of the Convention, we are not responsible for injury to or loss, sickness or death of an animal, which we have agreed to carry unless we have been negligent.

PETS THAT CANNOT BE ACCEPTED FOR TRAVEL:
The following pets cannot be accepted for travel on Aer Arann:
Puppies or kittens under 10 weeks old.
An animal that is more than 6 weeks pregnant.
Pets so sedated, they cannot stand up.

RESTRICTED DOG BREEDS:

The following types of dogs cannot be accepted for travel, including cross-breeds:
Snub-nosed dogs , American Pit Bulls, Pit Bull Terriers, Japanese Tosas, Fila Brazileiros, Togo Argentinos, all Bull dogs, Pugs, Pekinese. ( These snub-nosed dogs suffer from respiratory problems that increase with stress and so cannot be accepted for travel.)

2.6 MUSICAL INSTRUMENTS.

Large delicate musical instruments that exceed our cabin baggage dimensions may be carried in the cabin if a seat for it has been reserved and the appropriate fare paid.
All Musical Instruments accepted for carriage will be accepted on a ‘Limited Release’ (i.e. entirely ‘at your own risk’ for loss, damage, or delay) basis. You will be required to sign acknowledgement of ‘Limited Release’ at the time of check-in. You may therefore wish to ensure that you have suitable private insurance cover for your journey.

2.7 SPORTING EQUIPMENT

The carriage of out of gauge baggage such as sporting equipment, which cannot be checked in the normal manner as it requires special handling (including but not limited to: golf clubs, bicycles, body boards) is subject to an additional charge of EUR 15 / GBP 10 per sector (flight) and per item irrespective of weight. Due to space restrictions we recommend that all sporting equipment is pre-booked and pre-paid by calling your local reservation centre, as not to do so may result in the item being refused carriage at the airport. If due to additional space restrictions such out of gauge baggage cannot be pre - booked, it will only be accepted at check in if space is available, on payment of the appropriate fee. If the fee is not paid at the time of booking or on your outbound it will still be imposed on your return journey.

Aer Arann is prepared to carry such items of Sporting Equipment on a ‘Limited Release’ (i.e. entirely ‘at your own risk’ for loss, damage, or delay) basis. You will be required to sign acknowledgement of ‘Limited Release’ at the time of check-in. You may therefore wish to ensure that you have suitable private insurance cover for your journey.

Sporting equipment will only be carried on a ‘Space Available’ basis.

2.8 SPORTING WEAPONS/ FIREARMS.
Aer Arann does not permit the carriage of weapons, firearms or ammunition.

ARTICLE 3- CONDUCT ABOARD AIRCRAFT.

3.1 GENERAL:

You are not permitted to smoke in any part of an aircraft operated by Aer Arann.

You are not permitted to consume your own alcohol aboard an aircraft. We reserve the right to refuse to serve or sell alcohol to any passenger on board the aircraft.

For safety reasons, we may forbid or limit operation aboard the aircraft of electronic equipment, including but not limited to cellular telephones, laptop computers, portable recorders, transmitting devices, radio controlled toys or walkie-talkies, CD players, I Pods or other similar items, electronic games devices and portable radios.
Operation of hearing aids and heart pace makers is permitted.

If, in our reasonable opinion, you conduct yourself aboard the aircraft so as to endanger the aircraft or any person or property on board, or obstruct the crew in the performance of their duties, or fail to comply with any instructions of the crew including but not limited to those with respect to smoking, alcohol or drug consumption, or behave in a manner which causes discomfort, inconvenience, damage or injury to other passengers or the crew, we may take such measures as we deem reasonably necessary to prevent continuation of such conduct, including restraint. You may be disembarked and refused onward carriage at any point, and reported to the relevant authorities with a view to having you pros ecuted for any criminal offences committed on board the aircraft.

If as a result of your behaviour we divert the aircraft for the purposes of off loading you, you must pay us the costs of the diversion and any fines or penalties imposed on the airline by the government of the country to which we have diverted.

ARTICLE 4- RIGHT TO REFUSE CARRIAGE.
In the reasonable exercise of our discretion, we may refuse to carry you or your baggage if we have notified you in writing that we would not at any time after the date of such notice carry you on our flight. In this circumstance you will be entitled to a refund.

We may also refuse to carry you or your baggage if one or more of the following have occurred or we reasonably believe may occur:

• Such action is necessary in order to comply with any applicable government laws, regulations, or orders;
• The carriage of you or your baggage may endanger or affect the safety of the aircraft, or the safety, health , comfort of other passengers or crew;
• Your mental or physical state, including your impairment from alcohol or drugs, presents a hazard or risk to yourself, to passengers, to crew or to property;
• You have committed misconduct on a previous flight and we have reason to believe that such conduct may be repeated;
• You have refused to submit to a security check on you or your baggage.
• You have not paid the applicable fare, taxes, fees or charges;
• You owe us any money in respect of a previous flight owing to payment having been dishonoured, denied or recharged against us.
• You do not appear to have valid travel documents, may seek to enter a country through which you may be in transit, or for which you do not have valid travel documents, destroy your travel documents during flight, refuse to surrender your travel documents to the flight crew, against receipt, when so requested or refuse to allow us to photocopy your travel documents.
• You presented a ticket that has been acquired unlawfully, has been purchased from an entity other than us or an authorised agent, or has been reported as being lost or stolen, is a counterfeit, or you cannot prove that you were the person named in the ticket.
• You failed to observe our instructions with respect to safety or security.
• You have used threatening, abusive or insulting words towards our ground staff or crew of the aircraft.
• You have deliberately interfered with a member of the crew of the aircraft carrying out their duties.
• You have made a hoax threat relating to bombs, biological or chemical weapons.
• Y ou have put the safety of either the aircraft or any person in it in danger.
• You have committed a criminal offence during the check in or boarding process or on board the aircraft.
If we have, in the reasonable exercise of our discretion under this Article refused to carry you on the basis of any of the above, or have removed you en route, we may cancel the remaining unused portion of your ticket and you will not be entitled to further carriage or to a refund in respect of the sector(s) covered by the ticket. We will not be liable for any consequential loss or damage alleged due to any such refusal to carry or your removal en route.

ARTICLE 5- CHECK-IN AND BOARDING INFORMATION.

5.1 CHECK-IN

Aer Arann recommends that passengers check in 1 hour prior to scheduled departure. Check-in closes 30 minutes prior to scheduled departure. Check-in closes at Sligo and Donegal Airports 20 minutes prior to scheduled departure.

5.2 BOARDING

You should be at the boarding gate at least 20 minutes prior to departure. Boarding closes 10 minutes prior to departure. Passengers arriving late to the boarding gate will not be accepted for travel. Aer Arann reserves the right to cancel your reservation without refund, in such circumstances. We may cancel the space reserved for you if you fail to arrive at the boarding gate in time. We will not be liable to you for any loss or expense incurred due to your failure to comply with Check-in Deadlines or to arrive at the boarding gate in time. Should you wish to travel on a later flight, you will be required to make a new booking at the applicable fare. Passengers with Y class bookings, who have checked-in but who arrive late to the boarding gate can re-book on a later flight after paying a change fee of EUR 22 / GBP 15 per sector, subject to availability on a standby basis.

ARTICLE 6- FLIGHT CANCELLATIONS , REROUTINGS, SCHEDULE CHANGES AND WEATHER.

6.1 SCHEDULE CHANGES.

he flight times shown in timetables may change between the date of publication and the date you actually travel. We do not guarantee them to you and they do not form part of your contract with us.

If the time change is greater than 30 minutes later than the time you were advised we will endeavour to contact you (phone or email or sms) on the contact details presented to the airline or authorized agent at the time of booking.

If the new scheduled time is earlier than the time you were advised we would endeavour to contact you (phone or email or sms) on the contact details presented to the airline or authorized agent at the time of booking.

If the time change is greater than 2 hours, and this is unsuitable to you, all monies including taxes will be refunded in full. We will take all necessary measures to avoid delay in carrying you and your Baggage. In the exercise of these measures and in order to prevent a flight cancellation, in exceptional circumstances we may arrange for a flight to be operated on our behalf by an alternative Carrier and/or aircraft.

6.2 CANCELLATIONS.

Except as otherwise provided by the Convention or EC regulation 261/2004 , if we cancel a flight, fail to operate a flight reasonably according to the schedule, fail to stop at your destination or Stopover destination, or cause you to miss a connecting flight on which you hold a confirmed reservation on a conjunction ticket, we shall act in accordance with the Montreal convention and EC regulation 261/2004.If you flight becomes cancelled we would endeavour to contact you (phone or email or sms) on the contact details presented to the airline or authorized agent at the time of booking.

6.3 DELAYS

If you flight becomes delayed we may endeavour to contact you (phone or sms) on the contact details presented to the airline or authorized agent at the time of booking, if reasonably practicable.

6.4 WEATHER DIVERSIONS.

Flights affected by adverse weather conditions may cause disruption to passengers. Aer Arann will endeavour to operate all services to the destination airport but may have to divert to alternative airports or offer alternative surface transport. If a flight is diverted to an alternative airport, Aer Arann will ensure that all passengers will be transported to their destination airport.

ARTICLE 7- RESERVATION CHANGES (only through Call Centre or Airport Ticket Desks)

7.1 CHANGES.

Flight and date changes are allowed subject to the following conditions:
Aer Arann Reservations & Departure Airport:
Flight dates and flight times are changeable up to 30 minutes prior to scheduled departure with Aer Arann Reservations (subject to availability & reservation centre opening hours) or the departure airport but only upon payment of a minimum change fee of EUR 22 for domestic flights and EUR 22 / GBP 15 for UK flights, per person per change transaction (except Y class bookings).

Flight and date changes require you to pay the difference in price between the original fare paid and the lowest available fare for the new booking at the time. If the available fare is lower on the new flight, no refund will be made.
The same passenger name must be used for all flights within a booking.

7.2 MISSED FLIGHT:

A missed flight fee of €50/£35 is payable where a passenger arrives late (maximum one hour after scheduled departure time ) for their flight and wishes to book onto a new flight. This fee is only available at the departure airport. This change must be made on the same day of the original flight.
Bookings made in Y class are not liable for any change fee or for the missed flight fee up to 1 hour after schedule departure time.

If you fail to contact an authorized agent or us within 2 hours after the scheduled departure time, you must purchase a new ticket. The original flight is non refundable. (Y- Class bookings can avail of a refund less the applicable administrative charges but must purchase a new ticket for travel .)

7.3 ROUTE CHANGES:

Route changes are permitted prior to commencement of outbound sector, up to 30 minutes prior to check-in closure and restricted to currency used at original booking. A fee of EUR22.00/GBP15.00 per person per change transaction is applicable. If the new fare booked is higher that the original fare, an upgrade must also be paid amounting to the difference between the two fares. If the fare available on the new flight is lower than the original fare, no refund will be made.

7.4 NAME CHANGES:

Name changes are permitted prior to commencement of outbound sector, up to 30 minutes prior to check-in closure. A fee of EUR30.00/GBP20.00 per name per booking is applicable.

7.5 LOST/ STOLEN TICKETS:

Except in the case of an Electronic Ticket, you shall not be entitled to be carried on a flight unless you present a valid Ticket containing the Flight Coupon for that flight and all other unused Flight Coupons and the Passenger Coupon at the time of Check-in. In addition, you shall not be entitled to be carried if the Ticket presented is mutilated or if it has been altered otherwise than by us or our Authorised Agent. In case of loss or mutilation of a Ticket (or part of it) by you or non-presentation of a Ticket containing the Passenger Coupon and all unused Flight Coupons, issued by an official Aer Arann Agent, travel will be permitted upon payment of a ‘Lost Ticket Fee’ provided there is evidence, readily ascertainable at the time, that a Ticket valid for the flight(s) in question was duly issued and you sign an agreement to reimburse us for any costs and losses, up to the value of the original ticket, which are necessarily and reasonably incurred by us for misuse of the Ticket. We will not claim reimbursement from you for any such losses, which result from our own negligence. The applicable administration fee for this service, unless the loss or mutilation was due to the negligence of the issuing carrier, or its agent, is €22/£15. If another airline or an authorized agent on behalf of another airline issued the Ticket, that specific airline must re-issue the Ticket. If this is not physically possible at the Departure Airport, you must purchase a new Ticket for travel.

If, upon finding the original Ticket before the expiry of its validity, you surrender it to the carrier issuing the new Ticket, the foregoing refund will be processed at that time.

Failure to present your valid Ticket at the Boarding Gate will result in refusal of travel. If the Ticket was issued by an authorized Aer Arann Agent, travel will be permitted upon payment of €22/£15. No Cash can be taken at the Boarding Gates.

A ticket is valuable and you should take appropriate measures to safeguard it and ensure it is not lost or stolen.

7.6 CONNECTING FLIGHTS

Aer Arann accepts no responsibility for connecting flights where passengers hold separate tickets that are not with our agreed interline partners.

ARTICLE 8- PAYMENT INFORMATION.

8.1 CURRENCY

Fares, taxes, fees and charges are payable in the currency of the country in which the Ticket is issued, unless another currency is indicated by us or our Authorised Agent at or before the time payment is made. We reserve the right to make a refund in the same manner and same currency used to pay for the Ticket.

8.2 CREDIT, CHARGE, DEBIT- CARD HANDLING FEES.
Aer Arann levies a handling fee of EUR5.00/GBP4.00 for Amex, Diners and AirPlus cards. EUR4.00/GBP3.00 per booking for Visa and MasterCard and EU R1.50/GBP1.00 per booking for all debit cards . The fee is applicable on payment of the initial reservation only and does not apply to sub sequent changes, fees, or cancellations. If a credit/ debit/ charge card is dishonoured, denied or recharged against us an administration fee of €80/£50 will additionally be levied in cash.

8.3 Fuel Surcharge
Aer Arann levies a fuel surcharge of EUR 2.50/GBP 1.66 per passenger per sector.

ARTICLE 9- REFUNDS POLICY

All refund requests and queries must be in writing via email refunds@aerarann.com or post to the Refunds Department, Aer Arann, The Atrium, Dublin Airport, Co. Dublin, Ireland. All Aer Arann bookings (except Y class bookings) are non-refundable. Any requests for refunds of taxes, fees and charges will be refunded less an admin fee of €25/£20 per sector per person. If a flight is cancelled and the passenger refuses alternative travel a rrangements , the portion of the flight cancelled is fully refundable. If there is a schedule change of greater than 2 hours of the original time, the full booking is fully refundable.

ITINERARIES / TICKET COLLECTION
Aer Arann provides facilities for the collection of itineraries / tickets at the first departure airport. Where itineraries / tickets are to be collected, it is the responsibility of the passenger to ensure adequate time is allowed to enable check-in to be performed. The airline takes no responsibility for late arrival at check-in due to delays in the itinerary / ticket issuance process.

ARTICLE 10- AIRPORT CHARGES AND TAXES.

10.1 **NOTICE OF GOVERNMENT IMPOSED TAXES AND FEES**
The price of your ticket may include taxes and fees which are imposed on air transportation by government authorities, other agencies and the airport. These taxes, fees and charges, which may represent a significant portion of the cost of air travel, are either included in the fare, or shown separately in the >>TAX<< box(es) of this ticket. You may also be required to pay taxes, fees or charges not already collected.

10.2 AIRPORT CHARGES
In the case of pass engers departing from Waterford Airport, a €5 airport development fee is payable on departure.
In the case of passengers departing from Kerry Airport, an airport development fee of €6 payable at the time of booking and is included in the fare.
These charges are independent of Aer Arann and are subject to change, locations and amounts.

ARTICLE 11- INFANTS AND YOUNG PERSONS.

11.1 CARRIAGE OF INFANTS

Infants under the age of 2 years may fly on Aer Arann flights provided that they sit on an adult’s lap (one infant per adult). No baby / car seats are allowed in the cabin of the aircraft. A maximum of 6 infants only can be carried on board the aircraft. If the infant reaches the age of 2 years prior to the return journey they must pay the applicable fare, taxes, fees and charges for that part of the journey.

11.2 UNACCOMPANIED MINORS (UMS) AND YOUNG PERSONS (YPS)

Aer Arann will not accept unaccompanied children under 12 years of age for travel on Aer Arann scheduled services.
Children under 12 years of age cannot travel unless accompanied by a person of 16 years of age or older, who will take full responsibility for the child. The person taking responsibility for the child under 12 years of age will be required to sign the Aer Arann Young Flyers form of indemnity or equivalent used by handling agent.

Aer Arann will continue to accept passengers aged 12-15 inclusive travelling alone but will not provide special assistance for these passengers.
The Aer Arann Young Flyers form of indemnity , or the equivalent used by Handling Agents must be completed by a parent/guardian for these passengers at each airport of departure. The guardian must present valid photo ID for the Young Person.

A child between 12 -17 can travel out of France if they have a valid French Passport and has the equivalent of the Young Flyers Form, of Indemnity completed by a parent/guardian for these passengers at each airport of departure.

If the Child has only a National Identity Card, they will also need a certificate issued by the City Council with the name of the parents, with an official seal on the document, which will allow the the child to travel on their own. ( " Attestation d'autorisation de sortie" ("exit approval" ) The Young Flyers Form of Indemnity must be still completed by a parent/guardian for these passengers at each airport of departure.

ARTICLE 12- SPECIAL ASSISTANCE

12.1 GENERAL.

Acceptance for carriage of incapacitated persons, pregnant women, persons with illness or other people requiring special assistance is subject to prior arrangement with us. Pass engers with disabilities who have advised us of any special requirements they may have at the time of ticketing, and been accepted by us, shall not subsequently be refused carriage on the basis of such disability or special requirements.

Aer Arann or the relevant Airport Authorities will provide wheel chair facilities free of charge to any passengers requiring assistance. Passengers are required to advise the airline in advance of travel if any assistance is required.

1.2.2 PREGNANT PASSENGERS:

It is the responsibility of all pregnant passengers to advise Aer Arann of their condition at the time of booking.
Up to 28 weeks: Aer Arann will carry pregnant women without a doctor's certificate. Aer Arann handling staff may request the individual to sign an indemnity confirming that they are less than 28 weeks pregnant. 28-36 weeks: Pregnant passengers are required to present a recent doctor’s letter at the time of check-in confirming they are fit to travel within a certain period (covering dates of travel) and advising the delivery due date. If no letter is presented, Aer Arann reserves the right to refuse travel. 36 weeks and over: Aer Arann will not carry pregnant passengers over 36 weeks pregnant.

12.3 OXYGEN

Passengers cannot travel with their own oxygen for use within the cabin.
Aer Arann will supply oxygen to any passenger who requires it for travel. Aer Arann Reservations must be advised at least 7 days prior to travel. A fee of €90 per sector is applicable for the oxygen supplied. Passengers must also produce a recent doctor’s letter stating that they are fit to travel without medical assistance within a certain period (covering dates of travel). Passengers requiring oxygen are invited to produce this letter on the day of travel and failure to produce this letter could result in the refusal of travel. (Further specific details are available from the Reservations Centre.) The Carrier will not be liable for consequences arising from the use of the oxygen supplied.
12.4 MEDICAL SYRINGES

If for medical reasons, passengers need to inject themselves during the flight (e.g . diabetics) they are permitted to carry epi-pens in the cabin. Syringes can be carried but will remain under the care of the Captain in the cockpit of the aircraft for the duration of the flight, unless required during the flight. If they are required medication will be administered under the supervision of the cabin crew. They will be asked to produce medical evidence (a doctor’s letter will suffice) when they check in or at security screenin gs. This should be kept with them at all times.

PASSENGER NOTICE

CONDITIONS OF CONTRACT

1 . Carriage hereunder is subject to the rules and limitations relating to liability established by the Warsaw Convention Conventions unless such carriage is not "international carriage" as de fined by that Convention.

2 . To the extent not in conflict with the foregoing carriage and other services performed by each carrier are subject to: (i) provisions contained in the ticket, (ii) applicable tariffs, (iii) carrier's conditions of carriage and related regulations which are made part hereof (and are available on application at the offices of carrier), except in transportation between a place in the United States or Canada and any place outside thereof to which tariffs in force in those countries apply.

3 . Carrier's name may be abbreviated in the ticket, the full name and its abbreviation being set forth in carrier's tariffs, conditions of carriage, regulations or timetables; carrier's address shall be the airport of departure shown opposite the first abbreviation of carrier's name in the ticket; the agreed stopping places are those places set forth in this ticket or as shown in carrier's timetables as scheduled stopping places on the passenger's route; carriage to be performed hereunder by several successive carriers is regarded as a single operation.

4 . An air carrier issuing a ticket for carriage over the lines of another air carrier does so only as its Agent.

5 . Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, servants and representatives of carrier and any person whose aircraft is used by carrier for carriage and its agents, servants and representatives.

6. No agent, servant or representative of carrier has authority to alter, modify or waive any provision of this contract.

Carriage is subject to the above Conditions of Contract and to the Aer Arann General Conditions of Carriage.

7. For damages up to 100,000 Special Drawing Rights (approximately EUR 123,000) the air carrier shall not exclude or limit it’s liability by proving that it has taken all necessary measures to avoid the damage or that it was impossible for the air carrier to take such measures. Notwithstanding this provision, if the air carrier can prove that the damage was caused by, or contributed to by, the negligence of the injured or deceased passenger the air carrier may be exonerated wholly or partly from it’s liability in accordance with applicable law.’

**EU NOTICE REQUIREMENT**
If your journey involves a destination or stop in a country other than the one from which you depart, the Warsaw Convention Conventions may govern the liability of all airlines involved in your journey, including any portion thereof within a single country. This Convention limits the liability of airlines for death or bodily injury and for baggage loss, delay, or damage. Many air carriers, including all European Community air carriers, have waived the Warsaw Convention Conventions limits for death or bodily injury and the defence that they have taken all necessary measures to avoid the damage for the first 100,000 Special Drawing Rights of any such cl aim. In addition, in cases of bodily injury or death, many air carriers will make advance payments to the person entitled to compensation, if required to meet immediate economic needs in proportion to the hardship suffered. Community air carriers make such payments in accordance with Community Law. Other carriers may apply alternate provisions. We are not responsible for any illness, injury or disability, including death, attributable to your physical condition or for the aggravation of such condition.

** ADVICE TO NON-INTERNATIONAL PASSENGERS ON LIMITATIONS OF LIABILITY**
Passengers on a journey involving transportation wholly within Ireland are advised that the Warsaw Convention Conventions may be applicable and the Convention governs and in most cases limits the liability of Carriers for death or personal injury and in respect of loss of or damage to baggage.

**DANGEROUS ARTICLES IN BAGGAGE**
For safety reasons, dangerous articles such as those listed below, must not be carried in passengers cabin or hold baggage. Compressed gases (deeply refrigerated, flammable, non-flammable and poisonous) such as butane, oxygen, liquid nitrogen, aqualung cylinders and compressed gas cylinders; items with internal combustion engines: such as chainsaws, model aircraft, and lawnmowers. Corrosives, such as acids, alkalis, WET CELL BATTERIES, and items containing mercury (e.g. thermometers) or chlorine . Explosives, munitions, ammunition including blank cartridges, hand guns, shot guns, fireworks, Christmas crackers, flares and pistol caps. Flammable liquids and solids, such as lighters that need inverting before ignition, lighter fuel, MATCHES (safety matches may be carried on the person), firelighters, paints and thinners.

Radioactive materials. Oxidising materials, such as bleaching powder and peroxides. Poisons and infectious substances, such as insecticides, weed killers and live virus materials. Briefcases and attaché cases with installed alarm devices. Other dangerous articles, such as magnetised material, offensive or irritating materials. Medicines and toiletries in limited quantities required by passengers during the journey, such as hairsprays, perfumes and medicines might be carried.

Guns, Firearms & Weapons; any object capable, or appearing capable, of discharging a projectile or causing injury, including, all firearms (pistols, revolvers, rifles, shotguns, etc .), Replica and imitation firearms, Component parts of firearms (excluding telescopic sighting devices & sights), Air pistols, rifles and pellet guns, Signal flare pistols, Starter pistols, Toy guns of all types, Ball bearing guns, Industrial bolt and nail guns, Crossbows and Arrows , Catapults, Harpoon and spear guns, Animal humane killers, Stun or shocking devices, e.g., cattle prods, ballistic conducted energy weapons (lasers), Lighters shaped like a firearm, Ice Axes and Ice Picks, Open razors and blades (excluding safety or disposable razors with blades enclosed in cartridges),

Pointed/Edged Weapons & Sharp Objects; pointed or bladed articles capable of causing injury, including, Axes and hatchets, Crampons, Harpoons and spears, Lockable or flick knives with blades of any length, ceremonial knives, with blades of more than 6 cm., made of metal or any other material strong enough to be used as a potential weapon, Meat cleavers, Machetes, Sabres, swords and swordsticks, Scalpels, Scissors with blades more than 6 cm. in length,

Explosives and flammable Substances; any explosive or highly combustible substances which poses a risk to the health of passengers and crew or the security/safety of aircraft or property, including, Ammunition, Blasting caps, Detonators and fuses, Explosives and explosive devices, Replica or imitation explosive material or devices, Mines and other explosive military stores, Grenades of all types
Gas and gas containers, e.g., butane, propane, acetylene, oxygen—in large volume, Fireworks, flares in any form and other pyrotechnics (including party poppers and toy caps), Non-safety matches, Smoke-generating canisters or cartridges, Flammable liquid fuel, e.g., petrol/gasoline, diesel, lighter fluid, alcohol, ethanol, Aerosol spray paint, T urpentine and paint thinner, Alcoholic beverages exceeding 70% by volume (140% proof).

Chemical and Toxic Substances; any chemical or toxic substances which poses a risk to the health of passengers and crew or the security/safety of aircraft or property, including, disabling or incapacitating sprays, e.g., mace, pepper spray, tear gas, Radioactive material, e.g., medicinal or commercial isotopes, Poisons, Infectious or biological hazardous material, e.g., infected blood, bacteria and viruses, Material cap able of spontaneous ignition or combustion, Fire extinguishers.

Explosives, including detonators, fuses, grenades, mines and explosives, Gases: propane, butane, Flammable liquids, including gasoline, methanol, Flammable solids and reactive substances, including magnesium, firelighters, fireworks, flares, Oxidizers and organic peroxides, including bleach, car body repair kits, Toxic or infectious substances, including rat poison, infected blood, Radioactive material, including medicinal or commercial isotop es, Corrosives, including mercury, vehicle batteries, Vehicle fuel system components which have contained fuel.

In addition to the items listed under "dangerous articles", the following items will not be accepted for carriage in the cabin but can be accepted in the hold once suitably packed:

Catapults
Knives with blades of length under 6cm , including letter openers, made of metal or any other material e.g. polycarbonate or ceramic
Razor blades (both open bladed and safety razors)
Tradesmen's tools
Darts
Scissors
Hypodermic syringes (unless required for genuine medical reasons, proof of same required e.g. Doctors letter)
Knitting needles
Large sporting bats and clubs (e.g. Baseball and Softball bats, Golf clubs, Hockey sticks, Lacrosse sticks, Kayak and canoe paddles, Skateboards, Fishing rods,)
Billiard, snooker or pool cues.

Ski and walking/hiking poles
Notes: Any sharp objects in checked-in baggage should be securely wrapped to prevent injury to screeners and handling personnel

DEFINITIONS:

‘We’, ‘our’, ‘ourselves’, and us means Aer Arann.

‘You’, ‘your’, and ‘yourself’, means any person, except members of the crew, carried or to be carried in an aircraft pursuant to a Ticket. (See also the definition for ‘Passenger’.)

‘AIRLINE DESIGNATOR CODE’: means the two characters or two or three letters, which identify particular air carriers.

‘AUTHORISED AGENT’: means a passenger sales agent who has been appointed by us to represent us in the sale of air transportation on our services.

‘BAGGAGE’: means your personal property accompanying you in connection with your trip. Unless otherwise specified, it consists of both your Checked and Unchecked Baggage.

‘BAGGAGE IDENTIFICATION TAG’: means a document issued solely for identification of Checked Baggage.

‘BAGGAGE RECEIPT’: means a document issued by the airline to the passenger for Checked Baggage.

‘BOARDING PASS’: Document issued by the airline to the passenger to confirm all check-in formalities. The boarding pass must be presented at the boarding gate to gain access to the aircraft.

‘CARRIAGE’: is the equivalent of transportation.

‘CARRIER’: means an air carrier other than ourselves whose airline designator code appears on your Ticket or on a Conjunction Ticket.

‘CHARGE’: means amounts levied by third parties such as airport authorities.

‘CHECKED BAGGAGE’: means Baggage of which we take custody and for which we have issued a Baggage Receipt.

‘CHECK-IN CLOSURE’: means the time limit specified by the airline by which you must have completed all check-in formalities and received your boarding pass.

‘CONVENTION’: means whichever of the following instruments are applicable:

The Convention for the Unification of Certain Rules Relating to International Carriage by Air, signed at Warsaw, 12 October 1929 (hereinafter referred to as the Warsaw Convention);
The Warsaw Convention as amended at The Hague on 28 September 1955;
The Warsaw Convention as amended by Additional Protocol No. 1 of Montreal (1975);
The Warsaw Convention as amended at The Hague and by Additional Protocol No. 2 of Montreal (1975);
The Warsaw Convention as amended at The Hague and by Additional Protocol No. 4 of Montreal (1975);
The Montreal Convention (1999).

‘CONJUNCTION TICKET’: A Ticket issued to you by an Authorised Agent on our behalf, with relation to another Ticket with an agreed carrier, which together constitutes a single contract of carriage.

‘DAMAGE’: includes death, wounding, or bodily injury to a Passenger, or loss partial loss theft or other damage to Baggage, arising out of or in connection with carriage or other services incidental thereto performed by us.

‘DAYS’: means the calendar days including all 365/366 days of the year.

‘ELECTRONIC TICKET’: means the Itinerary/ Receipt issued by or on behalf of Carrier, the Electronic Coupons and, if applicable, a boarding document.

‘FEE’: means amount levied by Aer Arann.

‘ITINERARY/ RECEIPT’: means a document we issue to Passengers that contain the Passenger’s name, flight information and notices.

‘LIMITED RELEASE’: means an item of baggage accepted for carriage by the airline, which is unsuitable for carriage. The airline accepts no liability for delay, loss or damage to the specific item. The passenger must sign acknowledgement of ‘Limited Release’ at the time of Check-in.

‘PASSENGER’: means any person, except members of the crew, carried or to be carried in an aircraft pursuant to a Ticket.

‘RESERVATION’: means a flight or flights booked and paid for by a passenger and upon payment received, confirmed by the airline.

‘SDR’: means a Special Drawing Right as defined by the International Monetary Fund

‘SPACE AVAILABLE’: means that an item will be left to be one of the last items to be loaded onto an aircraft. If space permits, the item will be loaded.

‘ TAX’: means an impost for raising revenue for the general treasury.

‘TICKET’: means the Itinerary/ Receipt, issued by us to you, or the document issued by an authorized agent on our behalf to you for the purpose of travel.

‘UNCHECKED BAGGAGE’: means any of your baggage other than Checked Baggage.
